Online Course Participant Agreement

THE AGREEMENT

Jessica Haverkamp (“We” or the “Provider”) agrees to provide  “You” or “Participant” with access to Better Photos for Busy Parents - Composition (the “Course”) upon the following terms and conditions.

Description: An Online Course that may include lessons, forms, videos, diagrams, photos, assignments, quizzes and checklists.

Total Course Fees
Two purchasing options:

  1. Self-Guided Course: Four weeks access to course material.

  2. Course with Feedback & Support: Six weeks course access and in addition: a private course page with private links to submit images, deadlines for assignment submissions, feedback provided in written and/or video form.

Start Date: Confirmed in separate email with password
End Date: Course is available for a predetermined timeframe

TERMS AND CONDITIONS

  1. LICENCE TO USE WEBSITE & COURSE MATERIAL
    a. Subject to this Agreement, we grant you a non-exclusive, limited, non-transferable and revocable license to use the Materials solely in connection with your participation in the Course and use of the Website solely for your own personal and non-commercial use.
    b. You are granted the right to download any PDFs, make screenshots, store and print single copies of items comprising the Program for personal use but you may not share, communicate, publish or in any manner distribute to other parties the e-course password, readings, references, links or any other materials.
    c. After purchasing the Course, you may not be able to begin until the specified Course Start Date and must complete the Course by the specified Course End Date. If selecting the Course with Feedback option, you are responsible for sending in materials before course deadlines. Late assignments will be accepted at the discretion of the teacher.

  2. COPYRIGHT
    a. You agree that the Materials, the Course, the Website, and any other Services provided by the Course Provider are the property of the Course Provider, including all copyrights, trademarks, and other intellectual property (IP). You agree that the Provider owns all right, title and interest in and to the IP and that you will not use the IP for any unlawful or infringing purpose. You agree not to reproduce or distribute the IP in any way without express written permission from the Provider.

  3. COURSE AVAILABILITY
    a. Access to the course begins after the course fee is paid and a confirmation email to the Participant is sent. Participant access to the course will then start and remain online for four-weeks for the self-guided course, and six weeks for the interactive course option.
    b. Availability to the Course is restricted to limited number of participants each month to ensure quality of service.
    c. We may need to interrupt your access to the Course to perform maintenance or emergency services on a scheduled or unscheduled basis. You agree that your access to the Course may be affected by unanticipated or unscheduled downtime, for any reason, but that we shall have no liability for any damage or loss caused as a result of such downtime.

  4. PASSWORDS
    a. When you complete the purchase process, you will receive a password that will allow you to access the course content. You agree to maintain the confidentiality of your password and are fully responsible for all liability and damages resulting from your failure to maintain that confidentiality and all activities that occur through the use of your password.
    b. You agree to immediately notify us of any unauthorized use of your password or any other breach of security.
    c. The Provider will be entitled to at its discretion, change passwords from time to time.

  5. FEES & PAYMENT
    a. The total Fees for your Course are noted above. The entirety of the Fees are due and payable upon your registration in the Course. If payment is not complete by seven days after inquiry, you may forfeit your place in the Course.
    b. The fees for the online course are set out on the Course website. Special prices are offered from time to time. The Provider may also introduce discounts or bonuses to the Participant upon the purchase of other products or services.

  6. ACCEPTABLE USE:
    a. You agree not to use the Course or the Website for any unlawful purpose or any purpose prohibited under this clause. You agree not to use the Course or the Website in any way that could damage the Course, Website, Services, or general business of the Course Provider. You further agree not to use the Course or the Website:
    I) To harass, abuse, or threaten others or otherwise violate any person’s legal rights;
    II) To violate any intellectual property rights of the Course Provider or any third party;
    III) To upload or otherwise disseminate any computer viruses or other software that may damage the property of another;
    IV) To perpetrate any fraud;
    V) To publish or distribute any obscene or defamatory material;
    VI) To publish or distribute any material that incites violence, hate, or discrimination towards any group;
    VII) To unlawfully gather information about others.

  7. PRIVACY
    a. The Provider agrees to protect all personal information collected from the Participant for the purpose of providing the Program. The Participant agrees to the collection of and use of the personal information in accordance with the Privacy Policy of the Provider for the purpose of delivering and administering the Course, and required purposes such as tax requirements.
    b. Participant photos submitted during the course will be keep private and used only to communicate with the owner of the images. All photos from the Participant will be deleted after the duration of the course, unless expressed permission to use images is given.
    c. Participant agrees to use of Dropbox and Google Forms as vehicles for image delivery.

  8. REVERSE ENGINEERING & SECURITY
    a. You agree not to undertake any of the following actions:
    I) Reverse engineer, or attempt to reverse engineer or disassemble any code or software from or on the Course or Website;
    II) Violate the security of the Course or Website through any unauthorized access, circumvention of encryption or other security tools, data mining or interference to any host, user or network.

  9. TERM, TERMINATION; SUSPENSION:
    a. The Course and any of its accompanying Materials may not be shared with any party. If we suspect that the Course or Materials are being shared and/or that you have shared your log-in information with any party, we reserve the right to immediately terminate your access to the Course, in our sole and exclusive discretion.We specifically reserve the right to terminate this Agreement if you violate any of the terms outlined herein, including, but not limited to, violating the intellectual property rights of us or a third party, failing to comply with applicable laws or other legal obligations, and/or publishing or distributing illegal material or not paying the course fee.
    b. You may also terminate this Agreement at any time by contacting us and requesting termination. At the termination of this Agreement, any provisions that would be expected to survive termination by their nature shall remain in full force and effect. Please be advised that terminating this Agreement does not entitle you to a refund on any monies spent with us.

  10. NO WARRANTIES
    a. You agree that your participation in the Course and your use of the Website is at your sole and exclusive risk and that any Services provided by us are on an ‘As Is’ basis.
    b. We make no warranties that the Course or Website will meet your needs or that the Course or Website will be uninterrupted, error-free, or secure. We also make no warranties as to the reliability or accuracy of any information in the Course or on the Website. You agree that any damage that may occur to you, through your computer system, or as a result of loss of your data from your participation in the Course or your use of the Website is your sole responsibility and that we are not liable for any such damage or loss.

  11. FORCE MAJEURE:
    a. We are not liable for any failure to perform due to causes beyond our reasonable control including, but not limited to, acts of God, acts of civil authorities, acts of military authorities, riots, embargoes, acts of nature and natural disasters, and other acts which may be due to unforeseen circumstances.

  12. ELECTRONIC COMMUNICATIONS PERMITTED WITH THE PROVIDER:
    a. Electronic communications are permitted to both Parties under this Agreement.
